These Terms of Service govern purchases from and use of the Mystery Drop Co. LLC website. By accessing the website or placing an order, you agree to these Terms, our Return and Refund Policy, Shipping Policy, and Privacy Policy.
- ELIGIBILITY
You must be at least 18 years old or the age of majority in your jurisdiction to place an order. By ordering, you represent that the information you provide is accurate and that you are authorized to use the selected payment method.
- MYSTERY DROP PRODUCTS
Every Mystery Drop contains a stated number or range of randomly selected, individually packaged merchandise acquired in bulk. Customers cannot request particular products, brands, categories, sizes, colors, values, or conditions.
Packages are sold as received and may be original, opened, taped, resealed, relabeled, damaged, or associated with a customer return. Mystery Drop Co. does not open, inspect, test, authenticate, or evaluate the merchandise before shipment.
Product type, brand, condition, completeness, functionality, compatibility, safety, and retail or resale value are unknown and not guaranteed. Product photographs are representative examples and do not show the exact packages a customer will receive.
No purchase should be made with the expectation of receiving a particular item, minimum retail value, profit, or resale return.
- PRODUCT SAFETY
Customers are responsible for examining merchandise before using, wearing, consuming, applying, installing, charging, connecting, gifting, or reselling it.
Do not use products that appear recalled, contaminated, expired, damaged, unsafe, counterfeit, improperly labeled, or unsuitable for their intended purpose. Keep unknown products and packaging away from children and animals until examined by a responsible adult.
- PRICING, PAYMENT AND TAX
Prices may change without notice. The price charged is the price displayed at checkout when the order is submitted. Applicable shipping charges and taxes are displayed separately where required.
We may correct pricing or listing errors and may cancel and refund an affected order before fulfillment. Orders are subject to payment authorization and acceptance.
- ORDER ACCEPTANCE
An order confirmation acknowledges that we received the order but does not guarantee acceptance. We may decline or cancel orders because of inventory errors, suspected fraud, payment problems, shipping restrictions, listing errors, or other legitimate business reasons. If we cancel a paid order, we will issue an appropriate refund.
- SHIPPING
Processing and delivery are governed by our Shipping Policy. Customers are responsible for providing accurate shipping information. Carrier delivery dates are estimates unless expressly stated otherwise.
- RETURNS, CANCELLATIONS AND REFUNDS
Mystery Drops are final sale after fulfillment due to their randomized and unknown nature, except as required by law or provided in our Return and Refund Policy.
Cancellation requests must be received before processing or fulfillment and are not guaranteed after packing begins.
- INTELLECTUAL PROPERTY
The Mystery Drop Co. name, logos, graphics, photographs, website content, and other original materials are owned by or licensed to Mystery Drop Co. LLC and may not be copied, reproduced, or commercially used without written permission.
Third-party names or marks visible on merchandise or packaging belong to their respective owners. Mystery Drop Co. is not affiliated with or endorsed by those owners unless expressly stated.
- PROHIBITED USE
You may not use the website for unlawful activity, fraud, interference with website operation, unauthorized access, transmission of malicious code, infringement of another party’s rights, or submission of false or misleading information.
- THIRD-PARTY SERVICES
Our store may use third-party services, including Shopify, payment processors, shipping carriers, and analytics providers. Their services may be governed by separate terms and privacy practices.
- DISCLAIMER
To the fullest extent permitted by law, the website and Mystery Drop products are provided on an “as available” and “as is” basis. We do not make guarantees regarding specific contents, merchandise condition, functionality, compatibility, retail value, resale value, or profitability.
Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot legally be excluded.
- LIMITATION OF LIABILITY
To the fullest extent permitted by law, Mystery Drop Co. LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or merchandise.
Any limitation of liability applies only to the extent permitted by applicable law and does not apply where liability cannot legally be limited.
- GOVERNING LAW
These Terms are governed by the laws of the State of Indiana and applicable federal law, without regard to conflict-of-law principles.
- CHANGES
We may update these Terms periodically. The effective date displayed above identifies the latest version. Continued use of the website after an update constitutes acceptance of the revised Terms where permitted by law.
